Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “user”) and ExactSky Weather(“we,” “us,” or “our”) governing your access to and use of the website at exactskyweather.comand all related features (collectively, the “Service”).

By accessing or using the Service you confirm that you are at least 13 years of age (or the age of digital consent in your jurisdiction, whichever is higher), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, do not use the Service.

ExactSky Weather is a free weather information platform providing real-time conditions, hourly and 15-day forecasts, live radar, and curated weather news for cities worldwide. The Service is funded in part through third-party advertising.

Weather forecast data is sourced from Open-Meteo, an open-source meteorological API published under the CC BY 4.0 licence. ExactSky Weather accesses this data under Open-Meteo’s commercial API licence, which permits its use on an advertising-funded, commercial website. Radar imagery is provided by RainViewer. News content is aggregated from publicly available sources via NewsData.io. We do not originate, write, or editorially control third-party news articles.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

All weather data, forecasts, radar imagery, and related information are provided for informational and general-interest purposes only. They are not a substitute for:

• Official warnings and advisories issued by national meteorological services (e.g. NOAA, Met Office, BOM).
• Professional meteorological advice for aviation, maritime, agricultural, or emergency management purposes.
• Your own judgement and real-time observation of local conditions.

We expressly disclaim all liability for any harm, injury, loss, or damage arising from reliance on weather data or forecasts provided by the Service. Always refer to your local emergency management authority for severe weather guidance.

Certain features (such as weather alert subscriptions and saved cities) require you to create an account via a supported OAuth provider (Google or GitHub). By creating an account you agree to:

• Provide accurate information during registration.
• Maintain the security of your account by not sharing your credentials.
• Notify us immediately at legal@exactskyweather.com of any unauthorised access.
• Accept responsibility for all activity occurring under your account.

We reserve the right to suspend or terminate any account that violates these Terms, without notice.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Scrape, crawl, or systematically harvest data from the Service beyond normal browser usage without express written permission.
• Attempt to gain unauthorised access to any part of the Service, its servers, or related systems.
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
• Impersonate any person or entity, or falsely state your affiliation with any person or entity.
• Transmit any unsolicited commercial communications (“spam”) through the Service.
• Use the Service to develop competing weather data products without a separate licence agreement.
• Circumvent, disable, or interfere with security-related features of the Service.
• Use automated tools (bots, scripts) to generate ad impressions, clicks, or other engagement metrics.

All original content on the Service — including but not limited to the website design, layout, graphics, logos, and source code — is the exclusive property of ExactSky Weather and is protected by applicable intellectual property laws.

Weather data from Open-Meteo is licensed under the Creative Commons Attribution 4.0 International (CC BY 4.0) licence. Map data from OpenStreetMap is © OpenStreetMap contributors under the ODbL licence.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes only. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without express prior written consent.

The Service aggregates and displays news articles from third-party publishers. We do not endorse, author, or verify the accuracy of any third-party article, headline, image, or external link. All third-party content remains the intellectual property of its respective owner.

When you click a link to an external site, you leave our Service. We are not responsible for the content, policies, or practices of third-party websites. We encourage you to review the privacy policies of any external site you visit.

The Service displays advertisements served by Google AdSense and potentially other advertising networks. We are not responsible for the content of those advertisements. Advertisements are clearly labelled.

You agree not to click on advertisements fraudulently, generate artificial impressions, or interfere with the advertising systems on the Service. Such activity may result in immediate account termination and reporting to the relevant advertising network.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Accuracy, completeness, or timeliness of weather data, forecasts, or news content.
• Uninterrupted, error-free, or secure operation of the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXACTSKY WEATHER, ITS OPERATORS, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or other intangible losses.
• Damages arising from reliance on inaccurate or outdated weather information.
• Damages resulting from unauthorised access to or alteration of your data.

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for consequential damages; in those jurisdictions our liability is limited to the greatest extent permitted by law.

You agree to defend, indemnify, and hold harmless ExactSky Weather and its operators from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use of or access to the Service.
• Your violation of any of these Terms.
• Your violation of any third-party rights, including intellectual property rights.
• Any claim that content you transmit through the Service causes damage to a third party.

We may suspend or permanently terminate your access to the Service, with or without cause or notice, at our sole discretion. Causes for termination include but are not limited to violation of these Terms, illegal activity, or conduct harmful to other users or to us.

You may delete your account at any time from your account settings. Upon termination, all licences granted to you under these Terms will immediately cease. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law will survive termination.

These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict-of-law principles. For users in the European Union, mandatory consumer protection provisions of your country of residence also apply.

We encourage you to contact us at legal@exactskyweather.com to resolve any dispute informally before resorting to formal proceedings.

We reserve the right to update these Terms at any time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify registered users by email. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

If you do not agree with the revised Terms, you must stop using the Service and, if applicable, delete your account.
